Agreement of Release & Waiver of Liability
1. I am voluntarily participating in the exercise and training classes offered by Mind Over Muzzle Dog Training LLC in Cape Coral, Florida and surrounding areas, during which I will receive information and instruction about training dogs. I recognize that dog training requires physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the inherent risks and hazards involved. The exercises related to dog training will challenge my cardiorespiratory and musculoskeletal systems. I understand there are aerobic, anaerobic, strength, power, agility, flexibility and breathing components of the program. I understand and I am aware that the components of exercise/dog training are potentially hazardous activities and may cause injury.
2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the dog training program. I represent and warrant that I am physically fit and I have no medical problems, conditions, impairments, diseases or any other illness that would prevent my participation in the dog training classes or increase my risk of injury and/or illness as a result of partaking in any dog training program. I acknowledge that I have either had a physical examination and/or have been given permission from my physician to participate in a dog training program or that I have decided to participate this program voluntarily and without the approval of my physician and do hereby assume any and all responsibility for my participation in the program and all activities associated therewith.
3. I understand that I may receive physical assists or adjustments to enhance or correct my positioning and techniques by the trainer. I will take accountability for alerting the teacher of any injury or impairment in advance before class begins or if I do not want to receive any assists.
4. In consideration of being permitted to participate in the dog training program, I agree to voluntarily assume full responsibility For any and all risks, injuries or damages, known or unknown, including injury to my person and property which may be caused as a result of participating in the dog training program including use of any equipment belonging to Mind Over Muzzle Dog Training LLC. I assume any and all liability for damages of any kind allegedly attributed to the active, passive or gross negligent acts or omissions of Mind Over Muzzle Dog Training LLC, Its teachers and its employees. In further consideration of being permitted to participate in the program, I, my heirs, or legal representatives, do hereby waive, to the fullest extent allowable by law, knowingly, voluntarily and expressly, any claim that I may have against Mind Over Muzzle Dog Training LLC, its trainers and its employees for any and all liability, injury, accident, illness, damages, legal and medical fees sustained now or in the future resulting from my participation in the dog training program including use of any equipment belonging to Mind Over Muzzle Dog Training LLC. I, my heirs or legal representatives fully release and forever discharge, to the fullest extent allowable by law, Mind Over Muzzle Dog Training LLC, its trainers and its employees for any injury, accident, illness, damages, legal and medical fees or death caused by any of their active, passive or gross negligence or other acts. I understand that this waiver and release includes any and all claims based on active, passive, or gross negligence of the above parties.
5. Client warrants that they have disclosed all known behavioral or medical conditions of their dog. Mind Over Muzzle Dog Training LLC is not liable for any injuries or damages resulting from pre-existing conditions not fully disclosed by the client.
6. I have read the above release and waiver of liability and fully understand its contents, terms and conditions. I acknowledge that I am agreeing to this agreement voluntarily, and intend by my purchase of dog training services to be a complete and unconditional release of liability to the greatest extent allowable by law. If any provision of this Agreement shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and in lieu of any invalid, illegal, unenforceable provision a similar provision shall be added which is valid, legal and enforceable. This Agreement shall apply to all dog training classes taken, or hereinafter taken at or through Mind Over Muzzle Dog Training LLC.
Refund Policy & Training Acknowledgement
Payment is required to reserve training services. Evaluations, private sessions, group classes, packages, workshops, and special events are not considered booked or confirmed until payment has been received.
All sales are final. Mind Over Muzzle Dog Training LLC does not provide refunds for completed services, unused sessions, missed appointments, partially completed packages, group classes, workshops, special events, or services terminated due to client noncompliance with training recommendations or policies.
Dog training is not an exact science, and results cannot be guaranteed. The success of any training program depends on numerous factors including, but not limited to, the dog's temperament, genetics, health, age, environment, consistency of training, management practices, and owner participation.
By purchasing training services, the client acknowledges that Mind Over Muzzle Dog Training LLC makes no guarantees regarding specific behavioral outcomes, timelines, performance levels, service dog suitability, therapy dog certification, competition success, or any other training result. The client understands that progress varies between dogs and that training outcomes depend largely upon continued implementation of training recommendations outside of scheduled sessions.
Post Training Responsibility & Maintenance
Upon completion of training services, the client assumes full responsibility for continued implementation, maintenance, and reinforcement of all training protocols provided.
Dog behavior is not static and may change over time due to environmental changes, inconsistent handling, lack of reinforcement, aging, health, or other factors outside of the trainer's control.
Mind Over Muzzle Dog Training LLC is not responsible for behavioral regression or changes that occur after completion of training services. Additional sessions, refresher training, or follow up support may be required to maintain or modify behaviors in the future.
Any additional training, refresher sessions, or continued behavior support beyond the scope of the initial program are optional, available for purchase, and remain the responsibility of the client if ongoing assistance is desired.
Therapy Dog/Public Access Disclaimer
Mind Over Muzzle Dog Training LLC provides general obedience training, behavior modification, and socialization guidance that may support a dog's suitability for therapy work. However, we do not certify, register, or guarantee therapy dog placement or approval.
Therapy dog certification and evaluation decisions are made solely by a third-party organization (Therapy Dogs United) and completion of training does not ensure that a dog will qualify for or be accepted into any therapy dog program.
Clients who acknowledge that suitability for therapy or service dog work depends on multiple factors including temperament, behavior consistency, health, and the requirements of the evaluating organization. Any decision to pursue therapy dog certification or service dog status is the sole responsibility of the client.
Cancellation & Rescheduling Policy (Private Sessions)
To provide the best service to all clients, scheduled appointment times are reserved exclusively for you and your dog.
Clients may reschedule a session with a minimum of forty-eight (48) hours notice. Requests to reschedule with less than forty-eight (48) hours notice, missed appointments, no-shows, or failure to attend a scheduled session will result in the session being forfeited and counted as completed.
Mind Over Muzzle Dog Training LLC reserves the right to reschedule services due to severe weather, unsafe conditions, trainer illness, emergencies, or other unforeseen circumstances. In such cases, every effort will be made to reschedule the session at a mutually agreeable time.
Repeated cancellations, no-shows, or failure to participate in scheduled training may result in termination of services at the sole discretion of Mind Over Muzzle Dog Training LLC.
Cancellation & Rescheduling Policy (Group Classes)
Enrollment in a group class reserves a space that is unavailable to other clients. For this reason, missed group classes are not eligible for refunds, credits, transfers, or make-up sessions unless otherwise stated by Mind Over Muzzle Dog Training LLC.
Clients who are unable to attend a scheduled group class for any reason, including illness, travel, scheduling conflicts, or other personal circumstances, understand that the missed class will be counted as a completed class for purposes of the training package.
Mind Over Muzzle Dog Training LLC is unable to guarantee make-up classes for missed group sessions. Any make-up opportunities offered are provided solely at the discretion of the trainer and are not guaranteed.
Health & Vaccination Requirements
All dogs participating in training services, including private sessions, group classes, and events, must be in good general health and free from known contagious or communicable diseases including but not limited to Kennel Cough (Infectious Tracheobronchitis), Leptospirosis, Giardia, and Ringworm.
Clients are responsible for ensuring their dog is up to date on core vaccinations as recommended by their veterinarian, including but not limited to rabies, distemper, and parvovirus, unless otherwise advised by a licensed veterinarian.
Dogs showing signs of illness such as coughing, vomiting, diarrhea, lethargy, or other symptoms of contagious illness should not attend scheduled sessions or classes. Mind Over Muzzle Dog Training LLC reserves the right to refuse participation if a dog appears unwell or poses a potential health risk to others.
Additional Health Considerations
Dogs recovering from surgery, injury, or medical procedures (including spay or neuter surgery) should not participate in training until cleared by a veterinarian.
Clients are required to disclose any recent or ongoing medical conditions, injuries, or restrictions that may affect their dog's ability to safely participate in training activities. Clients are also required to disclosed any and all known behavioral issues including but not limited to bite history, history of aggression/reactivity towards humans, history of aggression/reactivity towards other animals, and a history of killing other animals.
Mind Over Muzzle Dog Training LLC may modify, postpone, or refuse participation in training sessions of a dog is not medically appropriate for physical or behavioral work at the time of service.
Photo, Video, & Media Release
The client grants Mind Over Muzzle Dog Training LLC permission to photograph, video record, and otherwise capture images or recordings of the client, members of the client's household participating in training, and the client's dog(s) during lessons, classes, workshops, evaluations, events, and related activities.
The client understands that such photographs, videos, recordings, and testimonials may be used by Mind Over Muzzle Dog Training LLC for educational, promotional, advertising, marketing, social media, website, print, and other business purposes without compensation.
The client waives any right to inspect or approve the finished product or the specific use of such media and releases Mind Over Muzzle Dog Training LLC from any claims arising from the use of these materials.
Clients who do not wish to appear in photographs or videos must notify Mind Over Muzzle Dog Training LLC in writing prior to the start of services. Reasonable efforts will be made to accommodate such requests; however, exclusion from all media cannot be guaranteed during public classes, workshops, or events.
Therapy Dog Visit Policies & Safety Guidelines
Therapy dog visits provided through Mind Over Muzzle Dog Training LLC are designed as structured, educational, and comfort based interactions with trained dogs in appropriate environments such as schools, community programs, or approved facilities.
These visits are not a substitute for medical treatment or mental health therapy and are intended for general enrichment, emotional dspport, and educational experiences.
Safety & Supervision
All interactions with therapy dogs must be supervised by the handler at all times. The handler reserves the right to modify, pause, or end any interaction if the dog shows signs of stress, overstimulation, or if safety concerns arise.
Participants are required to follow all handler instructions regarding approach, touch, positioning, and interaction with the dogs. Rough, unsafe, or inappropriate behavior toward the dogs may result in removal from participation.
Risk Acknowledgement
Participants and requesting parties acknowledge that therapy dogs are living animals and may behave unpredictably. While every effort is made to ensure safety and positive interactions, there is an inherent risk of minor injury such as scratches, jumps, or accidental contact.
Supervision of Minors
When therapy dog visits involve children or minors, appropriate adult supervision is required at all times by the requesting organization or facility.
Media Release
Participants and requesting organizations acknowledge that photos and video may be taken during therapy visits and may be used by Mind Over Muzzle Dog Training LLC for educational, promotional, and marketing purposes, including social media and website content, unless a written request to opt out is provided.
Policy Agreement
By submitting a request for a Therapy Dog visit, the client acknowledges that they have read, understood and agree to these therapy dog visit policies & Safety Guidelines.
